Tshenolo Phajane-Molebatsi: A Trailblazer in South Africa's Legal Arena

The legal landscape of 2026 is unrecognizable now from a decade ago, defined by rapid shift dismantling the rigid, traditional, and outdated norms. By this token, women in law are reshaping the South African legal landscape by fostering a more legitimate, diverse judiciary and legal professional ecosystem.

Their challenging journey in the legal profession is a testament to their unwavering resilience and determination. Many women have been at the helm of this change becoming trailblazers, advocating for gender equality in the legal field.

The endeavors are in the stride of making law an inclusive and safe profession for women, a sharp contrast from previous norms.

As per the Law Society of South Africa, female law practitioner’s account for 42% of South Africa’s professionals, trying to make it as a gender-equal profession. However, to bring an evident change into the system, certain widely established South African law firms report a higher percentage of gender-diversified leadership roles.

At the University of Cape Town, a study by researcher Dr Tamlynne Meyer titled ‘Women perpetually marginalised in South African law firms’, highlights the following: Meyer said that the legal profession was a historically male-dominant profession, where a hyper-competitive masculinized professional culture operates.

While there is much to celebrate in women’s advancement in the workplace, it is undeniable that many women in historically male-dominant professions such as the legal profession continue to experience myriad challenges as they pursue both a legal career and motherhood.

According to Meyer’s research, most law graduates are women, who also constitute the majority of new entrants admitted into the profession. However, at the most senior levels of the profession, notably the partnership level, women comprise only 28% of partners compared to their male counterparts. She said there were at least two male partners for every female partner.

With the vision of standing their ground and making a mark for themselves, women are proactively choosing to be an integral part of the legal industry that has been largely dominated by men for years.

Long-standing and deep-rooted biases around women in law, including stereotypes such as women embracing motherhood, less competent, and women being too soft and accommodative in leadership roles, have now begun to be contested and redefined.
